Terms and Conditions of Kart Hire

Using our pedal go-karts (“go-karts”) is a fun activity for all to enjoy. Safety, as you can appreciate, is paramount and therefore we ask you to read the following Terms and Conditions of Hire and make sure that anyone using our go-karts and safety equipment, is familiar with these Terms and Conditions of Hire.

Lake Macquarie City Council trading as Blacksmiths Beachside Holiday Park or Swansea Lakeside Holiday Park (“the owner”) agrees to hire the go-karts and safety equipment listed below (“Hired Equipment”) to the Hirer on the following Terms and Conditions of Hire.

I acknowledge that I engage in the hire at my own risk and have been provided with Hired Equipment. I agree to abide by the following Terms and Conditions of Hire of the Hired Equipment.

• I acknowledge that the driving of go-karts is inherently risky and may lead to injury or death. The Hirer voluntarily agrees to accept all risks and danger, prior to, during and subsequent driving of the go-karts, including damage or injury caused by other drivers.
• I acknowledge that it is as a condition of hire, for anyone operating the Hired Equipment to correctly wear all safety equipment provided by the Owner, during the period of hire.
• Children under the age of 18 are not allowed to hire go-karts unless permission has been granted by the Owner in its ultimate discretion and permission has also been given by the parent/guardian and the Terms and Conditions of Hire has been signed by a parent/guardian.
• I will at all times take full control of the Hired Equipment and assume full responsibility. I am aware of the limit of two people for the double go-karts and one person for the single go-karts and I will at all times supervise any other person being in control of the Hired Equipment during the hire and that no extra passengers to jump on the go-karts at any time.
• I will not allow children to sit on other people’s lap.
• I will ensure that the Hired Equipment does not leave Blacksmiths Beachside Holiday Park or be ridden in the area at the front entrance or near the boom gate.
• I will operate the Hired Equipment only on the roads within the grounds of Blacksmiths Beachside Holiday Park and in the designated areas marked on the park map which I acknowledge has been provided to me. I will not take the Hired Equipment into any public amenity such as camp kitchen or amenities blocks.
• I have a duty to act with good judgement and consideration for myself and others to refrain from BEHAVIOUR THAT EFFECTS THE SAFETY OF MYSELF AND OTHERS or the Hired Equipment itself and act in a responsible manner whilst using the Holiday Park and on the premises.
• I hereby warrant that I am in good health. I am not receiving any medication or taking any medication whatsoever that may affect or interfere with my ability to control the Hire Equipment and that I am free of any injury, medical conditions, disability, disease, or illness which may be aggravated by participation in the abovementioned sport activity or may affect or interfere with my ability to control the Hire Equipment.
• The Hirer indemnifies the Owner against all claim, demand, action, liability, suit lien off-set demand proceedings, application order, judgement including without limitation for any loss, damage, property damage, personal injury, injury, expense, accident, death, compensation, cost, fee, penalty, charge or payment of whatsoever nature caused by any act or failure to act of the Hirer or because of the Hire’s use of the Hired Equipment.
• I have not consumed any alcohol or drugs that may affect or interfere with my ability to control the Hired Equipment and I acknowledge that no alcohol or drugs are to be consumed or administered during the period of hire by any users of the Hired Equipment.
• I will be fully responsible for any loss, damage or injury and I agree to pay all costs involved caused by loss, damage or injury to Owner’s and/or the Park Manager’s equipment, property or staff.
• I will be fully responsible for any loss, damage or injury to any person or property and I agree to pay all costs involved caused by any loss, damage or injury to any person or property.
• I will not crash into other people, property, go-karts, vehicles, bikes, trees, shrubs, etc, or allow my go-kart to tow another go-kart or to be towed by anything.
• I will return the Hired Equipment hired promptly at the end of the period of hire as I am aware that there maybe are other bookings behind mine and I will be responsible for extra payments levied due to late returns.
• I will ride carefully and sensibly on roads and always keep to the left. 
• I will be aware of all cars and never park directly behind any vehicle. 
• I am aware that the total weight limit per go-kart is 120kg for a double and 100kg for a single and I will ensure these weight limits are not exceed at any time.

By completing the Declaration, I acknowledge that I have read, understand and agree to the above Terms and Conditions of hire. I understand that should I or anyone else in control of the Hired Equipment fail to comply with the above Terms and Conditions, the Owner and Park Manager have the right to retake possession of the Hired Equipment within the period of Hire and no refund will be paid.
